The owner of this website is BikerSpares limited ("we", "our"or "us") whose registered office is at Unit E, Pocket Nook Lane, Lowton, Cheshire. WA3 1AW.
These Terms and Conditions govern users ("you" or "your") of this website and the users relationship with us.
If you do not agree to these Terms and Conditions, please do not use the website, or if you have any queries regarding these Terms and Conditions then please contact us.
1. Agreement
By placing an order you agree to be bound by these Terms and Conditions, this is for our and your protection.
2. Amendments
We reserve the right to update these Terms and Conditions occasionally without prior notice, unless the change is major when it will be announced on the homepage of our website. It is your responsibility to check for such changes.
3. Registration
By registering your personal information with the website, you are required to provide details that are true, accurate and current, that you are not impersonating any other person and that you will contact us immediately of any changes to the personal information if you have an order currently being processed. If no order is being processed then you may update your information by updating your account on the website if you have registered for one.
4. Privacy Policy & Security
Our website uses an SSL certificate to protect traffic between yourselves and our website for certain pages containing personal information such as your order history and addresses.
Your data is secured by ourselves with access only given to limited people working for us. Limited parts of your information are given to payment providers for taking payment, delivery businesses for delivering the goods or to selected third party businesses for supplying goods direct to yourselves if we do not have the stock. No information is given that is not needed and no businesses will be given information unless expressly needed for processing an order.
All payments are taken via third party payment providers such as Google Checkout, PayPal and SagePay where they are responsible for the security of your payment information - no credit/debit cardinformation is kept by ourselves.
We will take all reasonable care to keep the details of your order and payment secure, but we cannot be liable for any loss you may suffer if a third party gains unauthorised access to your computer or Internet connection when using our website.
We also collect anonymous data via cookies and server logs. Cookies are small pieces of data in your web browser that allow us to anonymously identify different users of the website. This information is used to help us improve the website and in no way collects any personal information.
5. Indemnity
You agree to fully indemnify, defend and hold us, and our officers, directors, employees and suppliers, harmless immediately on demand, from and against all claims, losses, costs and expenses, including reasonable legal fees, arising out of any breach of these Terms and Conditions by you, or any other liabilities arising out of your use of this website or any other person accessing the website using your personal information.
6. Orders
Stock availability can not be guaranteed and all orders are subject to acceptance and availability. If the goods ordered are not available then you will be notified by email and you will have the option to wait until the item is available or to cancel your order. Payment will not be taken until the goods are in stock and ready to be dispatched.
Any orders placed by you will be treated as an offer to purchase the goods or services from us and we have the right to reject such offers at any time, such as if we believe the risk is too great, stock is not available or we are unable to supply the goods. You accept that all automated confirmations of your order which you will receive from us do not amount to our acceptance of your offer to purchase goods from ourselves. The contract will conclude between you and us when we take the funds from you.
7. Cancellation Policy
If you wish to cancel an order with ourselves then it is important you contact us as soon as possible after the time of order. If the goods are yet to be dispatched then no payment will be taken and the offer to buy will be cancelled. If the goods have already been dispatched then they can be returned by yourselves in their unopened condition as set our in our returns policy below.
8. Returns Policy
If you wish to return an item then you must contact us prior to returning the item. It is important that the goods returned contain the original order ID to make it easy for us to trace the order when it arrives and avoid delays in your refund or replacement.
Non-faulty/incorrect goods must be sent back in their original unopened condition within 7 days of the receipt date. Once received we will exchange the item or give a full refund of the goods only (Unless the reason for return is our fault, and we will refund the postage).

9. Price and Payment
All prices shown are inclusive of VAT where applicable at the current rates and are correct at the time of entering the information onto the system. We reserve the right, however, to change prices at anytime without notice to you.
10. Delivery
We aim to dispatch all orders to the shipment address on the order within 48 hours, this depends when the order is placed and stock availability. You should expect orders to arrive within four days, if orders do not arrive within seven days then please contact ourselves so we can investigate. Contact will always be made by us in the event of delays.
Orders may go by Royal Mail Special Delivery and require a signature, this is for our and your protection. It is your responsibility to make sure the goods can be signed for and accepted, delays occurring from this delay are accepted by you when accepting these Terms and Conditions. If this will cause an issue then please contact us before an order has been created.
11. Eligibility to Purchase
To be eligible to lawfully enter into and form contracts under English law you must be 18 years of age or over and register your real name, address, phone number, email address and any other details requested.
By offering to purchase goods and services you confirm to us that you are 18 years of age and your details are correct.
12.Intellectual Property
The content of the Website is protected by copyright, trade marks and other intellectual property rights and you accept that the content shall remain with us.
13. Limitation of Liability
The Terms and Conditions of the contract do not affect your statutory rights as a consumer.
Whilst we will try to ensure that material included on the Website is correct and accurate. Please check all goods before ordering by looking at the details, and picture if available. We are not responsible if the goods ordered do not fulfil their requirement, or fit the motorcycle/equipment they were purchased for. If we are informed of inaccuracies on the website then we will correct this as soon as we reasonably can.
14. Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales and any disputes will be decided only by the English courts.
